Terms and conditions

HTK H5P learning resources service (hereinafter referred to as HTK H5P) has been established with the aim of providing an environment for the creation of learning materials using H5P tools.

Centre for Educational Technology (hereinafter referred to as HTK) is the owner of HTK H5P as an environment and the controller of personal data processed in HTK H5P.

For the materials and other data entered into HTK H5P, HTK is the data processor by enabling the use of HTK H5P for the processing of the data, by providing user support for the use of HTK H5P and by hosting the data contained in HTK H5P on its servers. Users of HTK H5P are persons who use the HTK H5P environment. HTK is committed to protecting the personal data processed in HTK H5P and their privacy.

General terms and conditions

  • Use of the HTK H5P shall be deemed to be use of any information or data contained in the HTK H5P in any manner or for any purpose.
  • The HTK H5P may only be used for its intended purpose as an environment for the creation of educational material. The HTK H5P may not be used for illegal purposes.
  • HTK reserves the right to review, refuse to post, or remove any content or any portion of any content if any portion of the content appears inappropriate to HTK.
  • The user of HTK H5P shall immediately inform HTK of any existing deficiencies in the use of the environment (such as technical deficiencies or inappropriate content) by writing to priit.tammets@tlu.ee.
  • By using HTK H5P, the user accepts all the HTK H5P Terms of Use.

Creating and deleting a user account in the TLU H5P environment

  • You can create a user account in the HTM H5P environment using HarID.
  • By creating a user account, the user has the possibility to create and copy materials according to the license terms.
  • In order to delete a user account, the person must submit a request to the user account (priit.tammets@tlu.ee).
  • Once the user account is deleted, the user will not be able to create or copy materials in HTK H5P.

 Protection of personal data

  • The purpose of the collection and processing of personal data is the creation and management of user accounts and research.
  • HTK H5P processes personal data in accordance with the EU General Data Protection Regulation and the Personal Data Protection Act.
  • All appropriate organisational, technical and physical safeguards are applied when processing personal data.
  • Personal data may only be disclosed without the consent of the individual to an authority or a person who has a direct legal right to do so (such as a court or a pre-trial procedure) and a justified need to know.
  • Upon deletion of a user account, personal data may be kept in a HTK H5P backup for a limited period of time.
     

Processed user data

  • The personal data required to create a user account are the person's first name, surname and e-mail address.
  • For statistical research purposes, HTK H5P processes personal data in order to compile reports and statistical reports for the purpose of monitoring, evaluating and improving e-learning activities for scientific purposes. No personal data will be provided in the reports and reports produced.
  • In the event of suspected infringement of rights (e.g. copyright), we may, if necessary, transmit the user's personal data to the other party to the dispute. In order to protect the intellectual property, personal data and other such rights of HTK H5P users and third parties, HTK H5P will, upon receipt of a notification of infringement, forward the contact details of the sender of the notification and of the contributor of the learning resource in dispute. The purpose of providing contact information is to enable the parties to the dispute to identify the facts of the potential infringement and, if necessary, to pursue the dispute with law enforcement authorities.  

How long will your personal data be kept?

The personal data we request from you will be stored in the Digital Learning Resources Information System for as long as either:

  • the rules for the creation of e-learning resources funded by the European Social Fund (ESF) and/or public funding (retention by legislative act);
  • rules and guidelines established for e-learning resources (retention under a contractual relationship);

Your free will:

If you have not used your digital learning resources information system user account for 3 years, we have the right to set your user account status to inactive.

Ensuring data accuracy, amending and correcting data

  • Data processing in HTK H5P is only done over a secure connection (https).
  • Access to the processing of data is restricted to authorised and instructed persons only to the extent necessary for the performance of their duties.
  • The responsibility for the correctness of the data submitted to HTK H5P lies with the data entrant.

Responsibility of participants in data processing 

  • HTK H5P is hosted on servers managed by HTK and located in Estonia. The servers and HTK H5P software are maintained with up-to-date security updates.
  • HTK shall be responsible for the smooth operation of HTK H5P and for organising the necessary development work, providing user support for the information system, ensuring the preservation of the data contained in HTK H5P and making back-up copies. The minimum notice period for a planned service disruption is 12 hours.
  • HTK shall not be liable for any failure of HTK H5P caused by circumstances beyond HTK’s control.
  • HTK shall not be responsible for the data and content entered into HTK H5P by users.

User responsibility

  • It is the responsibility of the user to inform HTK user support at the following address.
  • Each user has the right to create material in HTK H5P. The material is private until the user makes it public. 
  • If the material contains content created by someone else that is uploaded to HTK H5P, the user is responsible for ensuring that the uploaded material has the appropriate copyright.
  • When copying material created by another author, it is the responsibility of the user to ensure that the licensing terms of the material being copied allow this.  
  • The user is responsible for ensuring that all content that he/she creates on HTK H5P is up-to-date and free of material errors, including, but not limited to, profanity, adult content, gratuitous violence, elements that violate applicable law in any way, etc.
  • If a user finds inappropriate content on HTK H5P, he/she shall report it to the administrator of HTK H5P by sending an e-mail to the user account priit.tammets@tlu.ee.
  • Upon receipt of the notification of inappropriate content, the HTK H5P administrator will remove the material from public view. If the HTK H5P considers the notification to be justified and the content in question is inappropriate, the material will be removed.
  • It is the responsibility of the user to ensure that the content that he or she creates on HTK H5P does not violate any rights of any person, including the rights to the protection of personal data, or any other restrictions or prohibitions provided by law.

 Retention, deletion and modification of user-added content

  • HTK H5P has the right (but not the obligation) to delete material if it has not been accessed or modified for at least 3 years to avoid the accumulation of outdated content. In the event that the user wishes to ensure the preservation of the material, it is recommended that it is stored on its own storage medium.

Content and quality of service

  • HTK H5P offers the service (the possibility to use the environment) free of charge.
  • HTK H5P is not responsible for the availability or maintenance of the service or any part thereof.
